Limitations and exclusions of liability
By signing up for a seminar, taking an online or correspondence course or engaging Design with Joy, LLC for services you agree to hold harmless and indemnify Design with Joy LLC, its principles, employees, volunteers, and associates from any and all liability including but not limited to accidents, deaths, detention, annoyance or delays.  Design with Joy, LLC is not liable for any loss, damage, or injury caused events and items over which it has no control. Reasonable changes in the schedule, itinerary, course outline or delivery format will be made as necessary or needed at the discretion of Design With Joy LLC.  Users of Design With Joy, LLC services agree on behalf of himself/herself, his/her dependents, and employees or associates to be bound by the terms and conditions of this agreement and releases and holds harmless Design with Joy, LLC and any of its representatives from any and all liability for bodily injury, illness, death, property loss, destruction, or damage resulting from any services or causes however occurring during any portion of, or in relation to Design with Joy, LLC and its operations and serices.

HOW DO YOU COLLECT INFORMATION & WHAT DO YOU COLLECT?
How did I end up on your mailing list and/or customer file?
The way we assemble our mailing list is very simple: We buy and/or rent mailing lists from regulatory bodies and/or professional organizations handling the professions we serve (architects, contract builders, interior designers and landscape architects). The mailing lists we purchase and/or rent only include names and addresses. Some regulatory state boards also provide us with your professional license/registration number and its expiration date. Few regulatory state boards provide e-mail addresses, telephone numbers and/or fax numbers. Most professional organizations only provide us with name and address.
If you do enroll in one of our classes, we will verify and complete the information we have on file and add your information to our customer file, which lists your name, address, telephone number, fax number, email address, website address, professional license(s) and/or memberships, all of which may be updated/corrected upon request.
o What other information do you collect and/or track when I register for a class, request information/assistance or initiate contact with Design with Joy?

List of classes taken with Design with Joy along with detailed accounting, audit and completion-related information such as date of registration, completion status (enrolled, waiting, completed, canceled, no show), scores, evaluation forms submitted, payment information, etc.

WHAT CONTROL DO I HAVE OVER THE INFORMATION THAT IS BEING COLLECTED OR TRACKED?
Design with Joy maintains "Do Not Mail", "Do Not Call", "Do Not Fax", "Do Not E-mail" lists to which you may be added upon request. Information that is being tracked may not be altered for any reason other than correcting an error.
How do I remove my name and address from your mailing list and/or customer file?
To be "removed" from future mailings, you simply need to call us or write to us and request to be added to our "Do Not Mail" list. It may sound contradictory but, the only way we can "remove" your contact information from our mailing list and/or customer file is to keep you listed on the appropriate "Do Not Mail" list. If you are a customer, it is necessary to add your name to the "Do Not Mail" list for both our mailing list and our customer file otherwise you may continue to receive mailings that use one or the other list as a source. Please keep in mind that even though we do our best to honor all "Do Not Mail" requests, it is difficult (especially for those requests linked to our mailing list) to guarantee that you will never receive anything from us. This is due to the fact that in many cases we are missing a unique identifying key (for example your professional license number) allowing us to easily and accurately remove all "Do Not Mail" requests from our mailing list (again these limitations apply particularly to mailing list "Do No Mail" requests since for customers we can use the customer number as a unique identifier to remove you from future mailings). Indeed, as much as it is easy to remove email addresses, fax or telephone numbers from a list, it is more difficult to achieve the same result with names. This is due to several factors:

We have many duplicate records with same name that are actually different persons;
We may have the same person on our mailing list several times because he/she is licensed in several states or belongs to several professional organizations;
When the "Do Not Mail" request was processed only those records where both the name and address matched were added to our "Do Not Mail" list;
If we do not have a unique identifier on file such as a professional license number then the next time our mailing list is updated, you may re-appear on our list simply because our system was not able to match your name on our "Do Not Mail" list and your name on the new mailing list being imported into our system. These are only few of the reasons why your "Do Not Mail" requests cannot be guaranteed. These are not excuses but rather a fair assessment of what our technology allows us to do.

I am a customer; how do I remove my telephone number, fax number and/or e-mail address from your customer file?

To have your telephone, fax or e-mail address removed from our customer file, simply call or write to us and request to be added to our "Do Not Call," "Do Not Fax," and/or "Do Not Email" list(s). It may sound contradictory, but the only way we can remove your contact information from our customer file is to keep you listed on the corresponding "Do Not" list(s).

HOW IS THE INFORMATION YOU COLLECT USED?

The information we collect helps us deliver a superior level of customer service. It allows us to better manage our relationship with you and enables us to improve the products and services we offer you.
Additionally, given the fact that Design with Joy serves the continuing education needs of licensed professionals, we communicate with licensed professionals on a regular basis (mainly by mail) to inform licensees of changes in or implementation of mandatory continuing education requirements as well as to keep licensees posted on the latest course offerings. Mailings to prospects consist of postcards and/or brochures. Customers may receive personal invitations, completion-related correspondence such as (but not limited to) confirmation of registration, transcripts, continuing education and billing-related letters.
Customers may occasionally receive phone calls, faxes and/or e-mails for the same purposes as those listed above or to allow us to fulfill their requests.

WILL YOU DISCLOSE THE INFORMATION YOU COLLECT TO OUTSIDE THIRD PARTIES?

Design with Joy will disclose personal information, when required by law or in the good-faith belief that such action is necessary to:
Fulfill a customer's order or request
Protect and defend the rights or property of Design with Joy, LLC.
Comply with the rules and statutes set by the state boards and/or professional organizations regulating the professions we serve. For instance, in some cases, Design with Joy must report the continuing education credits earned to regulatory boards and/or professional organizations, in which case personal information may be disclosed.
We are not responsible for any breach of security or for any actions of any third parties that receive the information. We are not responsible for such third party privacy policies or how they treat the information.

HOW DO YOU KEEP MY INFORMATION SAFE?

Online, Design with Joy safeguards this information by using industry standard SSL (Secure Socket Layer) encrypted servers. SSL codes the information transferred between you and the server, rendering it unreadable to anyone trying to intercept the information.
Onsite, Design with Joy stores the information in a secured database hosted in the United States. Access to that database is limited to authorized personnel only. Design with Joy further uses reasonable precautions to keep the information disclosed to us secure.

HOW DO I STAY ABREAST OF CHANGES IN YOUR POLICY?

We reserve the right to modify this policy. Additionally, we encourage you to give us feedback on how to improve our "Privacy Policy" and the way we handle your information. If we decide to change our Privacy Policy, we will post those changes online
